Is it possible to be expelled from High School for this?
Question: Scenario:
After getting off a bus coming from a C-Tech school to my High School, I was assaulted by a student who claimed that I was smoking marijuana on the bus. We went through a short brawl in which I only defended myself. The principal investigated the claim made by my attacker by asking other students on the bus as well as searching my bookbag and person. 5 out of approximently 25-30 students who ride the bus said they had seen me smoke more than once on the bus. They found a lighter, rolling papers, and remnants of the legal herb Artemisia vulgaris (Artemisia vulgaris is uncontrolled in the United States. This means all parts of the plant and its extracts are legal to cultivate, buy, possess, and distribute (sell, trade or give) without a license or prescription) however my school does not have any punishment or rules in it's Code of Conduct about smoking paraphernalia. They never found any pot and the Nurse vouched that I was not high when she treated me. I am 18 and a senior.
Answers: If what you said above is true and you did not skip something, there is no reason for you to be expelled, legally.
If you are expelled you can sue the school.
Also, you should see a lawyer immediately, as the school will take forever to have a formal hearing, while you are suspended.
probably
If its not illegal they have no cause to expel you. If they do expel you get your parents or yourself to get a lawyer. There is no evidence that you were smoking an illegal drug.
you should get suspended but not expelled.
If you smoke on the bus, you should be expelled.
yes
It depends on the general opinion they've got for you.
Sure, it's entirely possible to be expelled for anything, at least preliminarily. You could fight, win, and be reinstated and graduate, and you may or may not have a legal basis for doing so. Contact a lawyer if you get expelled or otherwise disciplined for smoking. Don't smoke on the bus or on school property, that's not smart.
They may try to expel you because it looks suspicious. What will happen first is that you will be placed on suspension pending a formal hearing. If that happens, do your research and present your case at the board hearing. However, the school board has a tendency to drag these things out, scheduling the final hearing sometimes weeks or even months later. This is to make their point to others. You might need to get legal advice. Usually the first legal consultation is free.
in whatever u do , think twice.say example u smoke-who will it affect others and your health.
I think a warning would suffice ,,,also one for that Dude who insulted you Good Luck,,,,
depends how strict the school is. you would probly get suspended or thrown in detention at the least...expulsion is probly a bit too extreme, but i think suspension would be the next step they'd take
When you walk a fine line legally (like your doing) and probably pissing people off (like it sounds), you can't expect the man to give you the benefit of the doubt.
It's not what you want to hear I know, but it's truthful.
You may be in for a hard time.
Good luck.
well if u ddnt take any drugs at all..as in never...then no. but there's no rules ryt? wont they juz send u for counselling or something?
if they so expel u for something u never did it wud be wrong of cors....coz u have been wrongly accused for something u never did in which u can sue the school.
if wat u said was true, then no, there is no way the school can expell u. u didnt break any rules. u just lost a bit of trust, which isnt rly a good thing to lose, but again, u havent broken any rules and more than likely havent broken rules of conduct. if they do expell u, i suggest getting a lawyer (which is of course favorable bc they r only supposed to defend u and try their best to win the case) and making a date w the court, the meaning of this to keep u in school and get u onto a good college.
High school is kind of an island from the US constitution.
The fact that you let them search your bags doesn't help your case. The fact that you were smoking on the bus (regardless of what you were smoking) doesn't help your case. I wouldn't touch this case with a ten foot pole.

School isn't free. The EDUCATION is. You still have to provide the necessary equipment. If the school provided everything, your parents taxes would shoot through the roof.
So many things that used to be will never be again. On the dustbin of history are schoolbells, they were useful ehen schools were much smaller and could be heard everywhere.
